Mutual Exchange

All tenants of Freebridge Community Housing who have a full, Assured Tenancy Agreement (though not those with an Assured Shorthold Tenancy - including those within their first 12 months as tenants of the Association and signed up to our 'Starter' Tenancy Agreement) have the right to exchange their accommodation with other Assured Tenants of any Housing Association or Secure Tenants of Local Authorities.

This right to mutually exchange tenancies is subject to the approval and consent of Freebridge Community Housing (and any other landlord involved if the exchange is not carried out with another of our own tenants), and also subject to the completion of a legal Deed of Assignment prior to the mutual exchange taking place.

Freebridge Community Housing may only refuse a tenant's request to mutually exchange a tenancy for certain reasons. These are:-

  1. if the tenant/s are subject to a current Notice of Seeking Possession or full possession proceedings have begun following the issue of such a Notice
  2. if the affect of the exchange would be to result in under-occupation or over-crowding of the accommodation
  3. if the property involved is reserved for specific people (for example the disabled, or those in sheltered housing) and the exchange is proposed to be with a tenant or tenant/s who do not meet this criteria
  4. if the tenant/s are in rent arrears or are in breach of any other condition or obligation of their Tenancy Agreement as at the date of their application to exchange. (including the condition of the property)
